Public Notice - Notice of intention to make Tree Protection Local Law 2026
Council gives notice under section 73 of the Local Government Act 2020 of its intention to make the Tree Protection Local Law 2026 (proposed new Local Law) to replace the existing Tree Protection Local Law 2016. The objectives of the proposed new Local Law are to:
- protect trees growing in the Frankston municipality;
- require a minimum standard of tree pruning within the municipality for the protection of trees and public safety;
- provide for the peace, order and good government of the municipality; and
- protect and enhance the amenity, landscape values, environment and biodiversity of the municipality.
The intended effect of the proposed new Local Law is to
- make it an offence to remove, damage, kill or destroy or direct, authorise or allow to be removed, damaged, killed or destroyed a tree, unless a permit has been obtained;
- make it an offence to carry out, or direct, authorise or allow to be carried out any works near a tree where any part of the works takes place within the tree protection zone, unless a permit has been obtained;
- make it an offence in defined circumstances to lop, prune, cut, trim or direct, authorise or allow to be lopped, pruned, cut or trimmed a tree, unless a permit has been obtained;
- stipulate procedures for applying for permits and issue of permits;
- allow impoundment of any item being used to undertake works in contravention of the local law and introduce release and disposal provisions for an impounded item; and
- prescribe penalties for offences under the local law.
A copy of the proposed new Local Law is available for inspection on Council’s website and at Council’s office.
Any person who wishes to make a submission to Council on the proposed new Local Law should do so by 5pm on Monday, 2 March 2026. Submissions should be marked “Submission – proposed Tree Protection Local Law 2026” and addressed to: Chief Executive Officer, Frankston City Council, PO Box 490, Frankston, 3199. Submissions may also be hand delivered to the Civic Centre, or emailed to info@frankston.vic.gov.au
Any person requesting to be heard in support their submission is entitled to be heard before Council or be represented by a person acting on their behalf and will be notified of the time and date of the hearing. Unless a submitter requests to the contrary, copies of submissions (including the submitters’ names and addresses) may also be included in the Council meeting agenda and minutes, which are a permanent public record, and which are published on Council’s website.
