Notice of Intention to Lease Land - Frankston Yacht Club
Notice is hereby given in accordance with section 190 of the Local Government Act 1989 (‘the Act’) that, subject to the approval of the Department of Environment, Land, Water and Planning (‘DELWP’), Frankston City Council (‘Council’) intends to enter into a lease with the Eureka Corporate Hospitality Group ABN 24 611 640 156 for part of the Frankston Yacht Club building located on the Frankston Foreshore Reserve.
In principle agreement has been reached between Council and Eureka Corporate in relation to the proposed lease, subject to DELWP approval and the completion of this public consultation process.
A plan which shows the area to be leased can be viewed on Council’s website or inspected at the Civic Centre, 30 Davey Street, Frankston.
Main lease provisions
- Ground Floor – Café
- First Floor – Restaurant, function and conference space
- Year 1 – rent free
- Year 2 – 25% of base rent ($220,000) or 2.5% of turnover (whichever is greater)
- Year 3 – 50% of base rent or 5% of turnover (whichever is greater)
- Year 4 – 75% of base rent or 7.5% of turnover (whichever is greater)
- Year 5 – Base rent of $220,000 or 10% of turnover (whichever is greater). Base rent is then subject to 4% annual increases.
- 6 years with 3 further terms of 5 years each
- Council contribution to fitout of $840,000
- Maintenance/outgoings are to be the lessee’s responsibility
Any person affected by the proposal may make a submission to Council.
All submissions received by 17 September 2018 will be considered by Council in accordance with section 223 of the Act.
Any person making a submission is entitled to request (in the submission itself) to be heard at a Council meeting in support of the submission, either in person or by a person acting on his or her behalf.
Notice of the meeting date and time will be given to each person who has lodged a submission.

Submissions may also be hand delivered to the Civic Centre, or emailed to firstname.lastname@example.org.
Submitters should note that Council is required to maintain a public register of submissions received during the previous 12 months.
Unless a submitter requests to the contrary, copies of submissions (including the submitters’ names and addresses) may also be included in the Council meeting agenda and minutes, which are a permanent public record, and which are published on Council’s website.
