Special Charge for the Construction of Cranhaven Road, Langwarrin

Notice of Intention to Declare a Special Charge

In accordance with a resolution of Frankston City Council (Council) made at its Ordinary Meeting 310 held on 11 December 2017, notice is given that Council intends to declare at a Council meeting in April 2018, a Special Charge under section 163(1) of the Local Government Act 1989 (the Act) for the purpose of defraying expenses in relation to the construction of Cranhaven Road, Langwarrin (Warrandyte Rd to Lapwing Cl). The proposed Scheme involves the construction of road pavement and surfacing, kerb and channel, stormwater drains, and associated works.

Owners of land and premises within the designated area of the scheme are considered by Council to gain special benefit by the construction of the proposal.  Contributing properties’ liabilities have been calculated using a unit allocation system.

Council intends to spend an estimated $362,000 on the works to be undertaken and to levy by way of the Special Charge an amount of $235,300. Council’s contribution of $126,700 considers the community benefits that are estimated to exist where the works will provide tangible and direct benefits to the broader community.

Any person may make a written submission to the Council under sections 163A and 223 of the Act.

In addition, any person who will be required to pay the Special Charge to be imposed by the proposed declaration may also make a written objection to the proposed declaration to Council under section 163B of the Act.

Copies of the proposed declaration of Special Charge and a detailed plan of the Scheme area are available for inspection at the Council offices, 30 Davey Street, Frankston, during normal business hours for a period of at least 46 days after the publication of this notice.

Submissions close at 5pm on Wednesday 31 January 2018.

Any person who has made a written submission, including objections, and has requested to be heard in support of their submission is entitled to appear in person or to be represented by a person specified in the submission before Council to hear submissions at a Council meeting in February 2018 at 7pm. Submitters will be notified of details of this hearing date.

Any person making a written submission is advised that the Council is required to make available for public inspection all submissions (including personal information) received during the previous 12 months. Details of submissions may also be included within the official Council Agendas and Minutes which are public documents and which may also be made available on Council’s website.

Council will consider any written submissions and take into account any objections in accordance with sections 163A, 163B and 223 of the Act.
