Frankston Basketball Courts Notice of Intention to Lease Land

Notice is hereby given in accordance with section 190 of the Local Government Act 1989 (‘the Act’) that Frankston City Council (‘Council’) intends to enter into a lease with the Frankston and District Basketball Association Inc. (‘FDBA’) for the land known as the Frankston Basketball Courts which forms part of the Kananook Reserve at 90 Bardia Avenue, Seaford.  In principle agreement has been reached between Council and the FDBA in relation to the proposed lease, subject to the completion of statutory processes. 

The area to be leased is shown hatched on the plan - the hatched grey area represents the existing stadium, and the hatched white area shows the proposed stadium.

Main Lease Provisions

The FDBA will surrender its existing lease at the commencement of the new lease.  The new lease will cover the entire site shown hatched in the plan, and will provide enhanced basketball and ancillary facilities.

Term

  • 20 years, plus one option for a further 20 years

Rent

  • $32,304.56 per annum during construction until practical completion of Stage 1 works
  • $60,000 per annum plus CPI upon practical completion of Stage 1 works
  • $80,000 per annum plus CPI at practical completion of Stage 1A works
  • Rent review to occur every seven years over the term of both the initial lease period and the option period, and the FDBA must continue to comply with its existing lease obligations including the obligation to furnish financial information.

Any person affected by the proposal may make a submission to Council.  All submissions received on or before 2 August 2017 will be considered by Council in accordance with section 223 of the Act.  Any person making a submission is entitled to request (in the submission itself) to be heard at a Council meeting in support of the submission, either in person or by a person acting on his or her behalf.  Notice of the meeting date and time will be given to each person who has lodged a submission.  

Submitters should note that Council is required to maintain a public register of submissions received during the previous 12 months.  Unless a submitter requests to the contrary, copies of submissions (including the submitters’ names and addresses) may also be included in the Council meeting agenda and minutes, which are a permanent public record, and which are published on Council’s website.
