Today, all municipalities in Victoria including Frankston, are covered by land use planning controls, which are prepared and administered by State and local government authorities. The legislation governing such controls is the Planning and Environment Act 1987 as amended in 2000.
A responsible authority, usually the local Council such as Frankston City, administers the Planning Scheme that applies to its geographic area to maximise the different needs, interests and lifestyle of the broader community.
A Planning Permit is a legal document giving permission to develop or use a piece of land for a specific purpose. A permit may also contain written conditions and endorsed plans showing the proposed development or use of land.
To obtain a permit an application is made to Council which is assessed to ensure that the provisions of the planning scheme are met.
What is the planning scheme?
The planning scheme controls land use and development within a municipality. It contains State and local planning policies, zones, overlays and other provisions that affect how land can be used and developed.
Every municipality has its own planning scheme.
