Step 4 - Advertising
Planning Permit Applications can often generate a great deal of interest within the community, particular to those surrounding a site where development is proposed.
In many instances when Council considers the granting of a permit may result in material detriment to other persons, the applicant is directed to give notice of the application pursuant to Section 52 of the Planning and Environment Act 1987.(i.e. advertise).
Notice of Intention
Notice can be given in a number of ways, via mail (usually only to immediately adjoining and opposite property owners and/or occupiers), a sign on site, and on occasion a notice in the local newspaper.
Signage
Council send an A3 size yellow sign to the Applicant.
It is the Applicants responsibility to:
- Laminate the sign and maintain it in good order and condition for a period of 14 (full) days from the date it is erected
- Erect the sign on the site within 1.5 metre of the property boundary facing the street
- Positioned the sign so that it is clearly visible from the street/road
- Erect the sign so that no part of the Notice exceeds a height of 2.0 metres from ground level
Access to plans
If you have been notified of an application in one of the ways listed above you are able to view the plans at the Council Offices (Cnr of Davey and Young Street, Frankston) Monday to Friday between 8.30am to 5pm until a final decision is made by the Responsible Authority on the application.
Should you wish to obtain a copy of the plans the following fees apply:
- Copy of A4 (first 20 pages free ) 25c per page
- Copy of A3 plans (first 20 pages free ) 50c per page
- Copy of A1 plans $6.80 per page (inc GST)
- Copy of A0 plans $11.50 ( inc GST )

What if I wish to make a comment on an application?
Submissions' can be made both in support and in opposition to an application. Submissions opposing or expressing concern about a planning permit application are referred to as 'objections'. For submissions to be considered by Council's Planning Department when determining an application they must be in writing using either an Objection to Planning Permit Application form or in person at the Council Offices. If making a submission to a planning application or in the form of a letter, you must contain the following:
- The planning application number
- The address of the site
- Your, name, address and telephone number
- Your reasons for objecting to or supporting the proposal
- Details of how the proposal will affect you
Petitions can be accepted however it should be noted that all correspondence will go to the first signatory on the petition only.
Submissions can be received up until Council makes a formal decision on an application; however you are encouraged to lodge submissions within the 14 day advertising period to enable adequate time for consideration of your views by both the Permit Applicant and Council's Planning Staff.
It should be noted that submissions to planning permit applications are public documents and are available for viewing upon request by the applicant and other members of the general public until the application has been determined by the Responsible Authority.
