Asset Protection
Why is Asset protection required?
Under Council's Local Law No. 7 (2003), asset protection must be taken out by the person(s) responsible for arranging the works, to ensure that Council's assets are not damaged as a result of the works being carried out. Council's assets include but are not limited to footpaths, nature strips, signs, nature strip trees, underground assets, pits and road pavement.
When is Asset protection required?
Asset protection is required for any building works valued at $20,000 or more, pool and/or spas valued $10,000 or more and all demolitions, and any other works deemed by a council officer to cause damage to council assets. Asset protection is taken out prior to the commencement of works to ensure that Council's assets are not damaged and the site is reinstated to the state it was prior to building works taking place.
Process
When a building permit is issued by Council, Building Surveyor or Private Building Surveyor an inspection of the site will be undertaken by an Asset Protection Officer. The officer will note any existing damage to Council assets at the time of the initial inspection and advise of the security deposit amount to be payable.
On completion of building works a Final certificate o Occupancy permit is issued by your building surveyor and notification is received a final asset protection inspection is undertaken to determine if any damage has been caused to Councils assets.
Where assets have been protected or restored to Council standard the security deposit will be refunded in full.
Failure to restore and make good damage caused to Council assets will result in Council undertaking repairs and the the security deposit being used and any balance invoiced to the applicant.
Asset protection fees are made up of a permit fee off $160.00 (non-refundable) and a security deposit, the security deposit amount varies depending on what assets surround the site. The asset protection officer will decide this amount when the initial inspection is undertaken.
